PRIVACY POLICY

BNX Software LLC and InterNACHI® Privacy Policy Effective Date: August 10, 2026

This Privacy Policy explains how BNX Software LLC and InterNACHI® (together, "BNX Software LLC and InterNACHI®," "we," "us," or "our") collect, use, disclose, protect, and handle information when you use BNX Software and related services (the "Service").

Introduction

BNX Software LLC and InterNACHI® provide inspection management, scheduling, reporting, communication, and related workflow tools. This Privacy Policy applies to information collected through the Service, including app.bnxsoftware.com, related websites, and approved third-party integrations.

This Privacy Policy governs personal information handled by BNX Software LLC through the Service. It does not govern personal information collected by an inspector on the inspector's own behalf outside the Service. You should consult the inspector's own privacy policy for information about the inspector's data-handling practices.

Information We Collect

BNX Software LLC and InterNACHI® may collect the following categories of information:

  • (a) Account Information: Name, email address, company name, account credentials, billing-related details, and similar account setup information.

  • (b) Inspection Data: Inspection reports, comments, narratives, templates, checklists, photos, videos, attachments, notes, scheduling details, property information, and records created or uploaded through the Service.

  • (c) Contact Information in Customer Records: Names, phone numbers, email addresses, mailing addresses, and other contact details relating to clients, customers, buyers, sellers, agents, brokers, contractors, tenants, landlords, occupants, vendors, and other persons associated with an inspection or transaction.

  • (d) Integration Data: Information obtained through integrations you choose to enable, such as QuickBooks Online customer records, invoice details, and related accounting or billing data.

  • (e) Usage and Device Information: Log data, browser type, device information, IP address, access times, and application activity used for performance, security, diagnostics, and support.

How We Use Information

BNX Software LLC and InterNACHI® use information only as reasonably necessary to:

  • (a) provide, operate, maintain, and secure the Service;

  • (b) generate inspection reports, schedules, invoices, and related records;

  • (c) sync data with approved third-party integrations you choose to connect;

  • (d) troubleshoot problems, provide customer support, and detect or prevent fraud, abuse, and security incidents;

  • (e) improve product features, reliability, workflows, and performance; and

  • (f) comply with legal obligations and enforce applicable agreements.

No Sale, No Sharing for Marketing, No Solicitation

BNX Software LLC and InterNACHI® do not sell, rent, trade, lease, broker, or otherwise monetize your personal information, Inspection Data, Contact Information in Customer Records, or Integration Data.

BNX Software LLC and InterNACHI® do not share or transfer your data to third parties for their own advertising, marketing, lead-generation, solicitation, referral, data-brokerage, profiling, or other independent commercial purposes.

BNX Software LLC and InterNACHI® do not use the information in your account or inspection records to contact, market to, solicit, or provide services to your clients, customers, buyers, sellers, agents, brokers, contractors, tenants, landlords, occupants, vendors, or other contacts associated with your inspections or transactions.

Limited Disclosure

BNX Software LLC and InterNACHI® may disclose information only in the following limited circumstances:

  • (a) to hosting providers, subprocessors, contractors, and service providers that help operate the Service and are subject to confidentiality and data-protection obligations;

  • (b) to comply with applicable law, regulation, legal process, subpoena, court order, or lawful governmental request;

  • (c) to investigate, prevent, or respond to fraud, security incidents, technical issues, or misuse of the Service;

  • (d) to protect the rights, safety, security, and integrity of the Service, BNX Software LLC and InterNACHI®, users, or others; or

  • (e) with your direction, instruction, or consent.

SMS and Text Message Data

BNX Software provides automated text messaging as a feature of the Service. This section describes how SMS-related data is collected, used, and shared.

What we collect for SMS

When an inspection company uses the Service to send automated text messages, BNX collects and processes the following data:

  • Recipient phone number, entered by the inspection company or provided by the recipient at the time of consent

  • The content of each message sent, including any customizations made by the inspection company

  • Delivery status returned by the mobile carrier (delivered, failed, pending, or rejected)

  • Timestamps of each message sent and each delivery status update

  • Records of consent, including the inspection company that captured the consent, the phone number, the date and time, and the source of consent (for example, an online scheduler submission)

  • Records of any STOP, UNSUBSCRIBE, or similar opt-out messages received from a recipient

How we use SMS data

SMS data is used only to:

  • Deliver transactional text messages requested by the inspection company (appointment confirmations, appointment reminders, reschedule or cancellation notices, and report-ready notifications)

  • Honor opt-out requests promptly and prevent further messages from being sent to opted-out numbers

  • Maintain records of consent and delivery for compliance with applicable law and mobile carrier rules

  • Investigate and resolve delivery problems or complaints

BNX does not use SMS data for marketing to recipients, does not sell SMS data to any third party, and does not share SMS data with any third party except as described below.

Sharing with our SMS provider

BNX uses Twilio, Inc. as its SMS delivery provider. To deliver a text message, BNX shares the recipient's phone number, the message content, and related metadata with Twilio. Twilio processes this information solely to deliver the message and report back its status. Twilio's handling of that data is governed by Twilio's own privacy policy at https://www.twilio.com/legal/privacy.

Retention

BNX retains SMS message records (recipient, content, timestamp, delivery status) and consent records for as long as required to demonstrate compliance with applicable law and carrier requirements, and to resolve any dispute about consent or delivery.

Your choices

Text messages are sent only to phone numbers that have affirmatively opted in — by clicking the confirmation link emailed after requesting text updates (checking the box when booking online is only the first step; no texts are sent until you confirm), or by texting START. If you no longer wish to receive text messages from an inspection company using the Service, reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text you receive. Your number will be opted out immediately. Once opted out, you will not receive further text messages sent through BNX for any inspection company that has previously texted you. You may re-opt-in later by replying START, UNSTOP, or YES to any message you previously received. To receive help, reply HELP or INFO to any message, or contact support@bnxsoftware.com.

You may also request information about, correction of, or deletion of your personal data (including SMS-related data) by contacting us at the address provided elsewhere in this policy.

Data Ownership and Control

As between you and BNX Software LLC and InterNACHI®, the data you create, upload, or store in the Service remains your data. BNX Software LLC and InterNACHI® do not claim ownership of your specific inspection reports or customer records, and do not claim ownership of your templates, comments, narratives, media, or other Customer Data.

Subject to legal retention requirements, backup retention cycles, fraud-prevention needs, dispute preservation, and other legitimate operational requirements, you may request deletion of your account and associated data.

Third-Party Integrations

If you choose to connect third-party integrations such as QuickBooks Online, BNX Software LLC and InterNACHI® will access and exchange data with those services only as necessary to provide the requested integration functionality.

Your use of third-party services is also governed by the privacy policies and terms of those third parties.

Security

BNX Software LLC and InterNACHI® use commercially reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, and disclosure. No method of transmission or storage is completely secure, and absolute security cannot be guaranteed.

Data Retention

BNX Software LLC and InterNACHI® retain information for as long as reasonably necessary to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, maintain backups, and protect the security and integrity of the platform.

Changes to This Privacy Policy

BNX Software LLC and InterNACHI® may update this Privacy Policy from time to time. The updated version will become effective when posted, unless a later effective date is stated.

Your continued use of the Service after the effective date constitutes your acceptance of the updated Privacy Policy.
